TooCacao Terms of Use
Last updated: October 12, 2026
These terms govern the use of the TooCacao app, which lets you scan, rate and discover chocolate
bars. By creating an account or using the app, you accept these terms as well as the
privacy policy.
1. Publisher
TooCacao is published by Fabrice Herrmann, an independent developer. The full contact details of the
publisher and of the hosting provider are given in the legal notice.
2. Access to the service
- The app is free. Any Internet connection costs remain your responsibility.
- TooCacao is intended for people aged 16 and over.
- Some features (tastings, favorites, adding chocolate entries) require an account, created with an email address or through Apple or Google. You are responsible for keeping your credentials confidential and for any action taken from your account.
- The publisher makes every effort to keep the app available but cannot guarantee it: the app may be interrupted for maintenance, change or be discontinued.
3. Content you publish
You remain the owner of the content you publish in TooCacao: tastings, ratings, comments, photos,
chocolate entries and places of purchase.
So that the app can work and show this content to other users, you grant the publisher a
non-exclusive, royalty-free, worldwide license to host, reproduce, adapt (for
example cropping a photo or translating a text) and display this content in the app, on the
toocacao.com website and in TooCacao's presentation materials (store listings, social media). This
license is granted for the duration of your rights; it allows a comment to be quoted with your
username, never with your email address.
- Tastings and comments: you can edit or delete them at any time; they are then removed from the app.
- Chocolate entries, bar photos and places of purchase: these contributions enrich the shared catalog. They remain available after your account is deleted, with no link to your identity.
You guarantee that you hold the rights to what you publish: a photo must have been taken by you and
must not show an identifiable person without their consent.
4. Code of conduct
TooCacao has zero tolerance for abusive content. You may not publish:
- insulting, defamatory, hateful, discriminatory, violent, sexual or unlawful content;
- content intended to harass or intimidate anyone;
- personal information about another person;
- advertising, promotional links or repetitive messages;
- fake reviews, in particular a chocolate professional rating their own products or a competitor's;
- content reproducing a third party's work (text, photo, logo) without permission.
Impersonating a person or a brand, including through your choice of username, is also forbidden.
5. Moderation and reports
- Published photos and texts (comments, usernames) are analyzed automatically. Content may be hidden while the publisher reviews it, then published or rejected.
- Any user can report a tasting or a chocolate entry from the app. Reports are reviewed as quickly as possible.
- The publisher may remove any content that breaches these terms and, in case of serious or repeated breaches, suspend or delete the account concerned.
6. TooCacao's intellectual property
The TooCacao name and logo, the app, its code, design, texts and database are the property of the
publisher and are protected by copyright, trademark law and the database producer's right (articles
L.341-1 et seq. of the French Intellectual Property Code). Any reproduction or reuse without written
permission is forbidden.
In particular, the following are forbidden:
- extracting or reusing a substantial part of the catalog, or repeatedly extracting insubstantial parts;
- using robots, scripts or any automated means to collect data from the app or its servers;
- decompiling or reverse engineering the app, except where permitted by law;
- any attempt to bypass security measures or disrupt the service.
7. Third-party data and trademarks
- Part of the product information comes from Open Food Facts: the data is licensed under the Open Database License (ODbL) and the photos under Creative Commons BY-SA. These elements remain subject to their respective licenses.
- The chocolate makers' names and trademarks belong to their owners. They are mentioned only to identify products; TooCacao is not affiliated with any of these brands.
- The map and place search are provided by Google; their use is subject to Google's terms.
8. Liability
- Ratings, comments and flavor profiles are the users' personal, subjective opinions and are their sole responsibility.
- The information in chocolate entries (origin, cocoa percentage, ingredients, labels) is indicative and may be incomplete or inaccurate. If you have an allergy or a special diet, always refer to the product packaging.
- The publisher cannot be held responsible for content published by users or for information provided by third-party services.
9. Deleting your account
You can delete your account at any time from the Profile screen of the app ("Delete my account"
button). The data that is deleted and the data kept without any link to your identity are detailed in
the privacy policy.
10. iOS and Android apps
On iOS, Apple's standard
license agreement applies in addition to these terms. Apple and Google are not responsible for the
app or its content.
11. Changes to these terms
These terms may change. The last update date is shown at the top of this page. In case of a
significant change, you will be informed in the app or by email; continuing to use TooCacao means you
accept the new terms.
12. Governing law
These terms are governed by French law. In case of dispute, an amicable solution will be sought
first. Failing that, the French courts will have jurisdiction, without prejudice to the protective
rules you enjoy as a consumer in your country of residence.
